These Terms of Service govern your access to and use of Luckets.com and your purchase of products offered through the website.

Luckets.com is operated by Optime Plus LLC. Throughout these Terms, “Luckets,” “we,” “us,” and “our” refer to Optime Plus LLC.

By visiting Luckets.com, creating an account, submitting content, or placing an order, you agree to these Terms of Service and the policies referenced in them. If you do not agree, do not use the website or purchase our products.

1. Eligibility and Account Information

You must be legally able to enter into a binding agreement in your place of residence to use our services or place an order.

When you provide account, contact, billing, or shipping information, you agree that the information is complete, current, and accurate.

You are responsible for:

• Protecting your account credentials

• Restricting unauthorized access to your account

• Reviewing the accuracy of your order information

• Notifying us if you believe your account has been accessed without authorization

We may suspend or terminate access to an account that is used fraudulently, unlawfully, or in violation of these Terms.

2. Products and Services

Luckets sells physical DTF transfers, including ready-to-press designs and products prepared using customer-submitted artwork.

We make reasonable efforts to display product descriptions, dimensions, colors, designs, prices, and availability accurately. However:

• Colors may appear differently depending on the customer’s screen and device settings.

• Product appearance may vary slightly because of production and material characteristics.

• Measurements may have minor production tolerances.

• Application results may vary depending on the material, heat press, temperature, pressure, pressing time, peeling method, storage, and care.

Product images and mockups are provided to help illustrate the design and intended use. Unless expressly stated, garments, accessories, equipment, and background items shown in product images are not included.

3. Personal and Commercial Use

Unless a product listing states otherwise, customers may use physical Luckets DTF transfers for:

• Personal projects

• Business projects

• Applying designs to physical products

• Selling finished physical products containing an applied Luckets transfer

• Reselling genuine, unaltered physical Luckets products when purchased for legitimate wholesale or retail resale

Purchasing a physical product does not transfer ownership of the underlying artwork, design, trademark, copyright, digital file, product photography, or other intellectual property.

Customers may not:

• Copy, scan, trace, digitize, recreate, or reproduce Luckets artwork

• Extract or distribute digital design files

• Sell or distribute unauthorized copies of a design

• Claim ownership or authorship of Luckets artwork

• Use Luckets trademarks, photographs, or branding in a misleading manner

• Manufacture competing transfers from Luckets designs without written authorization

Any additional license restrictions stated on a product page will also apply.

4. Customer-Submitted Artwork

When you upload or submit artwork, text, logos, photographs, or other content, you represent and warrant that:

• You own the content or have permission to use it.

• The content does not infringe any copyright, trademark, privacy, publicity, or other third-party right.

• The content is not unlawful, deceptive, defamatory, hateful, obscene, or otherwise prohibited.

• Luckets may lawfully reproduce the content to fulfill your order.

You grant Luckets a limited, non-exclusive license to store, process, modify as technically necessary, reproduce, and use the submitted content solely to review, produce, fulfill, support, and document your order.

We may refuse or cancel an order containing content that we reasonably believe is unlawful, infringing, unsafe, deceptive, or inconsistent with our policies.

You remain responsible for spelling, dimensions, resolution, image quality, backgrounds, transparency, colors, and all other elements of customer-submitted or approved artwork.

5. Orders and Order Acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges that we received the order but does not necessarily mean the order has been accepted.

We may refuse, limit, hold, or cancel an order for reasons including:

• Suspected fraud or unauthorized payment

• Incorrect pricing or product information

• Product unavailability

• Shipping restrictions

• Intellectual property concerns

• Prohibited customer-submitted content

• Unusual order quantities

• Violation of these Terms

If we cancel a paid order, we will refund the applicable amount to the original payment method.

Orders may enter production shortly after submission. Cancellation or modification requests cannot be guaranteed after production begins.

6. Prices, Taxes, and Payment

Prices are displayed in U.S. dollars unless otherwise stated.

Applicable taxes, shipping charges, discounts, and the final order total are displayed during checkout before payment is submitted.

You agree to provide accurate payment information and confirm that you are authorized to use the selected payment method.

Payments may be processed through Shopify Payments, Shop Pay, PayPal, Google Pay, credit card networks, or other payment providers. These providers may apply their own terms and privacy policies.

We may correct genuine pricing, calculation, or listing errors. If an error affects an order that has already been placed, we may contact you for instructions or cancel and refund the affected order.

7. Promotions and Discount Codes

Promotions and discount codes:

• May have separate eligibility requirements

• May be limited by product, customer, date, location, or order value

• Cannot be combined unless expressly permitted

• Have no cash value

• May be modified or withdrawn before an eligible order is placed

• May not be reproduced, sold, or used fraudulently

If promotion-specific terms conflict with these Terms, the promotion-specific terms control for that promotion.

8. Production, Shipping, and Delivery

Processing and delivery estimates are provided in our Shipping Policy:

Processing time and carrier transit time are separate.

Delivery dates are estimates and are not guaranteed. Carrier delays, weather, incorrect addresses, service interruptions, and other circumstances outside our reasonable control may affect delivery.

Customers are responsible for providing a complete and accurate delivery address. Contact support@luckets.com as soon as possible if an address needs to be corrected. Address changes cannot be guaranteed after processing or shipment begins.

9. Returns, Replacements, and Refunds

Returns, refunds, replacements, cancellations, and eligible product claims are governed by our Return and Refund Policy:

Because DTF transfers are prepared after an order is placed, many products cannot be returned because of a change of mind or an incorrect customer selection.

Nothing in these Terms limits any consumer right that cannot lawfully be waived.

10. Application and Product Use

Customers are responsible for reviewing and following the application and care instructions provided on Luckets.com or with the product.

Application results may be affected by:

• Fabric or substrate composition

• Heat press condition and calibration

• Temperature

• Pressure

• Pressing time

• Peeling method

• Environmental conditions

• Storage

• Washing and drying procedures

We recommend testing the transfer, material, and application settings before beginning a large production run.

Luckets is not responsible for damage caused by improper storage, application, equipment settings, garment preparation, washing, drying, ironing, or use inconsistent with the provided instructions.

11. Intellectual Property

The Luckets.com website and its original content—including branding, text, graphics, product photographs, videos, designs, logos, page layouts, and other materials—are owned by or licensed to Optime Plus LLC and are protected by applicable intellectual property laws.

Except for the limited product-use rights described in these Terms, no content may be copied, reproduced, modified, distributed, published, displayed, sold, or commercially exploited without prior written authorization.

“Luckets” and associated branding may not be used in a way that suggests sponsorship, endorsement, affiliation, or authorization without written permission.

12. Reviews, Feedback, and Submitted Content

If you voluntarily submit a product review, photograph, testimonial, suggestion, or other feedback, you grant Luckets a non-exclusive, worldwide, royalty-free license to display, reproduce, format, and use that content for operating and promoting the business.

You confirm that:

• Your submission reflects your honest experience.

• You have the right to submit the content.

• The content does not violate another person’s rights.

• You have disclosed any incentive or compensation associated with the submission.

We may moderate or remove content that is unlawful, fraudulent, irrelevant, abusive, misleading, infringing, or otherwise inappropriate.

We will not knowingly publish a customer’s private contact or payment information as part of a review.

13. Prohibited Uses

You may not use Luckets.com or its services to:

• Violate applicable law

• Commit fraud or make unauthorized payments

• Infringe intellectual property rights

• Submit unlawful or unauthorized artwork

• Introduce malware, viruses, or harmful code

• Interfere with website security or operation

• Scrape, harvest, or collect data without authorization

• Impersonate another person or business

• Submit false or misleading information

• Abuse promotions, chargebacks, or refund procedures

• Attempt to gain unauthorized access to accounts or systems

We may restrict or terminate access when we reasonably believe these restrictions have been violated.

14. Third-Party Services and Links

Luckets.com is hosted by Shopify. Shopify provides the ecommerce infrastructure that enables us to operate the store, but purchases from Luckets are transactions directly between the customer and Optime Plus LLC.

Our website may include services or links provided by payment processors, shipping carriers, social platforms, analytics providers, or other third parties.

We do not control third-party websites or services and are not responsible for their independent content, availability, security, policies, or practices. Your use of a third-party service may be subject to that provider’s terms.

15. Privacy

Our collection and use of personal information are described in our Privacy Policy:

Information may also be processed by Shopify, payment providers, shipping carriers, and other service providers as necessary to operate the store, process payments, prevent fraud, fulfill orders, and provide customer support.

16. Electronic Communications

By placing an order or contacting us electronically, you consent to receive transactional communications related to your inquiry, account, order, payment, shipment, refund, or customer support request.

Marketing communications are optional. Where available, you may unsubscribe through the link included in the marketing message. Unsubscribing from marketing does not prevent necessary transactional communications.

17. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Luckets.com and its content are provided on an “as available” basis.

Except for warranties that cannot lawfully be excluded, we do not guarantee that:

• The website will always be uninterrupted or error-free.

• Every product will appear exactly the same on every screen or material.

• A transfer will produce identical results with all fabrics, equipment, or application settings.

• Delivery will occur on a guaranteed date.

Nothing in this section excludes any warranty, remedy, or legal protection that cannot lawfully be excluded.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Optime Plus LLC will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of the website or products, including lost profits, lost business, or loss of data.

For a claim arising from a particular order, our aggregate liability will not exceed the amount paid for the product giving rise to the claim, except where a different limitation is required by applicable law.

These limitations do not apply to liability that cannot lawfully be limited or excluded.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Optime Plus LLC and its owners, employees, contractors, and service providers from third-party claims, losses, or reasonable expenses resulting from:

• Your violation of these Terms

• Your unlawful use of the website or products

• Customer-submitted content that infringes another party’s rights

• Your misuse or unauthorized reproduction of Luckets content

• Your violation of applicable law or a third party’s rights

This section does not require a consumer to indemnify Luckets for Luckets’ own unlawful conduct.

20. Events Outside Our Control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including severe weather, natural disasters, carrier interruptions, labor disputes, governmental actions, supply interruptions, internet or utility failures, cyber incidents, or other force majeure events.

We will make reasonable efforts to communicate material delays and complete affected orders when practical.

21. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal law, without regard to conflict-of-law principles.

Subject to any rights or remedies that cannot lawfully be waived, disputes relating to these Terms or purchases from Luckets will be brought in a court with appropriate jurisdiction in Virginia.

22. Severability and Waiver

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or separated from the Terms. The remaining provisions will continue in effect.

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

23. Assignment

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, or other lawful business transaction.

24. Entire Agreement

These Terms, together with the policies referenced in them, constitute the agreement between you and Optime Plus LLC concerning your use of Luckets.com and purchases made through the website.

If a product listing or promotion contains additional terms, those additional terms apply to that product or promotion. If there is a direct conflict, the more specific terms control.

25. Changes to These Terms

We may update these Terms to reflect changes in our services, business practices, technology, or legal obligations.

The current version will be posted on this page with the updated revision date. Changes apply prospectively from the stated effective date unless applicable law requires otherwise.
